Terms and Conditions
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

Cooling-off Period: The period within which the consumer may exercise the right of withdrawal.

Consumer: A natural person not acting for purposes related to trade, business, craft, or profession who enters into a distance contract with Marrievelle.

Day: Calendar day.

Distance Contract: A contract concluded between Marrievelle and the consumer within the framework of an organized system for distance selling of products, where up to and including the conclusion of the contract, exclusive use is made of one or more means of distance communication.

Durable Medium: Any tool that enables the consumer or Marrievelle to store information addressed personally to them, in a way that allows future consultation and unchanged reproduction of the stored information.

Right of Withdrawal: The consumer’s option to withdraw from the distance contract within the cooling-off period.

Trader: Marrievelle.

Website: The official online store operated by Marrievelle where products are offered for sale.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by Marrievelle and to every distance contract concluded between Marrievelle and the consumer.
Before the distance contract is concluded, the text of these Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, Marrievelle will indicate how the Terms and Conditions can be accessed electronically, and that they will be provided free of charge upon request.
In case specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always invoke the applicable provision that is most favorable to them in case of conflicting terms.
Article 4 – The Offer
If an offer is subject to a limited validity period or specific conditions, this shall be explicitly stated.
The offer contains a clear and accurate description of the products offered, enabling the consumer to make a proper assessment. Obvious mistakes or errors in the offer are not binding.
Every offer clearly states the rights and obligations that apply when the consumer accepts it, including but not limited to:

The price, including taxes

Delivery costs (if applicable)

Method of payment, delivery, and performance

The right of withdrawal and applicable conditions
Article 5 – The Agreement
The contract is concluded at the moment the consumer accepts the offer under the conditions set out by Marrievelle.
If the consumer accepts electronically, Marrievelle will immediately confirm receipt of acceptance of the offer.
Marrievelle will take appropriate measures to ensure secure electronic transactions and a safe online environment for consumer data.
Marrievelle may verify whether the consumer can meet their payment obligations. If reasonable grounds exist, Marrievelle is entitled to refuse an order or to attach special conditions.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period starts:

On the day the consumer receives the product, or
-
If the order is delivered in parts: on the day the consumer receives the final part.
To exercise the right of withdrawal, the consumer must notify Marrievelle within the withdrawal period via an unambiguous statement (e.g., by email).
Article 7 – Consumer’s Obligations During the Cooling-off Period
During the cooling-off period, the consumer must handle the product and packaging with care. They may only use the product as necessary to determine its nature, characteristics, and functioning, in the same way as would be allowed in a physical store.
If the consumer uses the product beyond what is necessary, they are liable for any diminished value.
Article 8 – Exercising the Right of Withdrawal
The consumer can withdraw by sending an email with order details to info@marrievelle.com.
As soon as possible, but no later than 14 days after withdrawal, the consumer must return the product.
The consumer bears the cost of returning the product unless otherwise agreed.
Marrievelle will reimburse all payments received from the consumer, including delivery costs (if charged), within 14 days after withdrawal, using the same payment method used by the consumer.
Article 9 – Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to:

Products made to the consumer’s specifications or clearly personalized.

Products that are not suitable to be returned for reasons of health protection or hygiene and were unsealed after delivery.

Products that, by their nature, are inseparably mixed with other items after delivery.
Article 10 – Prices
All prices of the offered products include VAT.
During the validity period stated in the offer, prices will not be increased, except for changes due to VAT or other legal requirements.
Article 11 – Performance and Warranty
Marrievelle guarantees that the products comply with the contract, the specifications stated in the offer, and legal requirements.
If the delivered product is defective, the consumer must notify Marrievelle within a reasonable time.
Article 12 – Delivery and Execution
Marrievelle will exercise the utmost care in receiving orders and delivering products.
Delivery shall take place at the address provided by the consumer.
Marrievelle shall dispatch accepted orders as quickly as possible, but no later than 30 days, unless a longer delivery period has been agreed.
If delivery is delayed or an order cannot be fulfilled, the consumer will be notified within 30 days. In this case, the consumer may cancel the contract free of charge and is entitled to a refund.
Article 13 – Payment
Unless otherwise agreed, payments must be made at the time of ordering through the available payment methods.
The consumer has the duty to report inaccuracies in provided payment details to Marrievelle immediately.
Article 14 – Complaints Procedure
Marrievelle has a clear and accessible complaints procedure.
Complaints about product performance or services must be submitted as soon as possible, but no later than 7 days after discovery of the issue, via email: info@marrievelle.com.
Complaints will be addressed within 14 days. If more time is required, Marrievelle will provide a timeline.
Article 15 – Applicable Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands.
Any disputes shall be submitted to the competent court in the Netherlands, unless otherwise required by mandatory consumer law.
